The crux is whether or not it can be proved that this guy actually turned and tried to fire the tazer at the cop....because most tazers have a one shot deal with cords attached to the battery … and if was the same cop in the original scuffle that fired the fatal shots. Mind you, each year I see videos and news briefs of cops going through nearly identical crap with drunken white revelers at Spring Break, Madi Gras, New Year's Eve. If it resulted in fatal shootings, it's so rare I never heard of it.

It is used by EVERY federal LE agency and I would safely say 99.5% of the state and local PDs in America. I have even seen slight variations of it overseas. Pay attention to to the 4th level, LESS-Lethal Methods, notice it does not say NON-Lethal Methods[/I][/B]. A taser in the hands of a trained officer is less lethal than a firearm, but people have died from it's use, same with an expandable baton(the modern version of a "Billy club"). If you hit someone in the common peroneal nerve in the leg with an expandable baton they usually stop fighting because of the pain, but if you hit someone upside the head with that same expandable baton, that is considered deadly force. Same with a taser(or CED), hit someone in the head or the neck with that thing and you could kill them, or like your mom used to say, you could put someone's eye out. Then it would be at the least, assault with a deadly weapon. Why can the cops get away with it? Because dirtbags like this asshole place their bets and roll the dice. The cops go ONE LEVEL BEYOND the level the criminal uses, because the criminal is not constrained by a use of force continuum. This shit is never gonna stop until these misguided "martyrs" are educated in the ways of the law and the consequences of stupidity.
