Here’s how I see it playing out.
The state still has jurisdiction and, at some point, they’ll have access to all the evidence. There’s sufficient evidence at this time to bring charges.
We already know that ICE violated every protocol imaginable. That will weigh with a jury. But what it will come down to is which of the three shots were fatal.
This ICE thug’s ONLY chance at self defense is that first shot through the windshield. If the autopsy shows it was fatal, he may be able to convince a jury of self defense.
If the other two are the fatal ones, he’s toast. The car had passed him and any perceived threat no longer existed.
Looking at the angle of the windshield shot and the videos, it appears to me that the first shot may well have NOT been the fatal one. Perhaps a right shoulder hit, but it’s difficult to tell. The vehicle was still proceeding quite slowly and to the right until the side window shots, almost certainly head shots, causing her foot to automatically press full down on the accelerator and going straight forward.
Now, we’ll see what the feds do with the evidence. Hopefully, they have not whitewashed anything, tampered, modified, or destroyed pertinent evidence. Based on the Trump administration’s past performance, I wouldn’t put it past these goons to fuck things up, intentionally, as much as possible
