If I was a plaintiff's lawyer I'd claim that given today's climate, they should have had a metal detector or x-ray scanner in place.

You have to prove negligence. You have to be able to prove that they could have reasonably prevented it.

For example. If your kid has a neighbor friend over to play and the kid falls out of a tree and breaks an arm unless you did something to cause it you cannot be sued. Well let me rephrase that. Someone stupid like you might try but you would fail.

I would argue that casinos are some of the most secure buildings in the world given the amount of money that is at stake.

It's a given that people can sue for anything. The discussion here is would a lawsuit have merit/hold up in court. I'm not a lawyer so I can't speak to it but if the expectation was to have a TSA type environment prior to this act then the Vegas strip will no longer exist.

Nobody said the families of victims "can't sue", did they? Suing doesn't mean winning. People who file frivolous lawsuits find that out eventually.

It will be interesting to see if contingent liability is brought to bear regarding any claims against the hotel.
