Good point. Just as we have a few here defending the accused because they are the right political flavor or a favored sports or entertainment figure, we have had those who pretended not to see what was going on right under their noses.
 
No, I am not. Contrary to what TTQ said, employers cannot fire you without cause if you belong to a protected class of employees. They also cannot fire union members without cause, and that almost always requires a long series of documented steps detailing the misbehavior. TTQ stated that the reason they want right-to-work is to be able to discriminate. That's not what it is; it's to prevent unionization and to weaken existing unions.... making it possible to pay lower wages, offer fewer benefits, and also to make it easier to get rid of unwanted employees without all the steps required by most unions.

If you are not a member of a protected class, you can be fired for no reason at all, absent an employment contract. If you are a member, you can still be fired just because they don't want you.... but there may be more documentation required, especially if several members of a particular class are laid off at the same time.

I've mentioned on here I was fired a month ago. I was working for a start up where they told us our Series B was coming for about six months and then one day it was 'no longer coming' and they laid off 3/4ths of the firm. They laid off the entire sales team of which I was a part. It was probably eight of us. They just called us in one by one and did it. All were male. I think seven were white and one was Hispanic.

Now say there was a different mix than that. Could the firm have done the same thing? (I would think yes because this is a start-up and you know, or ought to, the risk that most start-ups don't make it when you take the job). I'm assuming an Hispanic male is a protected class but I'm not sure. But this discussion made me think if the group had a larger black contingent in it, for example. Could they have fired the whole team then?

I'm obviously not an attorney, but I would say given the mix of people... especially since most of them were white and male.... there would be no repercussions to laying everyone or even most of you off. Since it was an entire department, the sales team, the company could rightfully argue that the business's sales were down, they were faring poorly, and thus there was no need for sales employees. What is a Series B?

I am very sorry to hear that you lost your job. And what a time for year for that too, as if there's a great time of year to get canned. Have you found something else yet?

As a health care provider, I cannot touch you -- even to just take your BP or temp -- without that consent. It's called "battery." If I performed something more invasive, such as draw blood, it becomes assault.

Absolutely. We are discussing the legalities of touching/grasping/groping another human being without their consent. There are a couple of tards here who thought that I was wrong to deck my boss when he grabbed my tit in front of a customer. It was a reflexive action. Boss hit the floor, and laughed, and told the customer that I have a temper too. Customer left in disgust. I quit my job. I was pointing out that even your physician, your dentist, your chiropractor, your nurse must obtain legal consent from you to render treatment; otherwise it's battery under the law. The only exceptions are for EMS employees.

Make sense now?

Thanks but it's ok. So many people work at start ups here dreaming of working for the next Google, Facebook etc. The reality is most of them fail. I've worked in corporate America before and done private individual investing. I wanted to try to the start up route. I went in eyes wide open.

I'm interviewing now and should have something here shortly (lol, at least I hope. this City isn't getting any cheaper living on savings)

Sorry, should have been more specific. Series B round of funding. Most firms start with seed money or a Series A round of funding. My firm had that. They told us for months the Series B was over subscribed blah, blah, blah. I knew they were full of sh*t, haha. So it was not a surprise at all when the layoffs came.
