Not a question who has power over the borders, obviously the Federal Gov't does, and yes they can use different approaches to confiscate that land, but since there is no precedent of any kind that applies, you'd have to be naive to think that the whole process wouldn't be tied up in Courts for an extended period of time

There is a precedent. Back in the Bush years he was building a fence at the border, and some land owners didnt want to sell. There was a court case that lasted over 10 years, just not sure how it ended.
