The felony murder rule does not require that you intended to kill someone, only that they died while you were committing the felony.

The felony murder rule does not require that you intended to kill someone, only that they died while you were committing the felony.

No - that's not felony murder. It's not enough that someone died WHILE you committed your felony. My gawd - that would make no sense. Your felony has to LEAD to the death of someone. Like if you rob a bank and a guard shoots at you and instead kills a bystander. Then YOU are guilty of felony murder. FWIW - I don't think that's right.

Anyway it appears heather died of a heart attack and since she was obese and it was a hot day it will be tough to prove that Field's alleged felony led to her death.

Won't be tough at all because a heart attack can be a proximate cause of death which still brings the felony murder rule into play; and 2) It is Virginia.
