McCloskey’s Gun Didn’t Work So A Prosecutor Ordered It Reassembled And Then Declared

Do you? All of those things depend on the specific details of a given situation as to whether or not they are illegal. You can't just consider the definition of the terms in a vacuum.

Tough shit for them. They shouldn't have been tromping around in front of her house acting in a loud, aggressive and threatening manner.

Show us where she "ran at" anyone "pointing a gun" at a particular individual.

She was standing in her front yard with her husband pointing an inoperable gun in the general direction of the protesters telling them to stay away.

Had you done what you described, you'd be receiving all your future birthday and Christmas cards in prison for the next 20 years or so.
Thanks for the revelation you are against Stand your Ground laws.

If you live in Missouri and own a firearm, essentially, you have the legal right to defend yourself and anyone else in serious danger with force as long as you have a legal right to be in that specific location.

The situation I described fell under Stand Your Ground. As to what the McCloskeys did, that will be revealed in court. Again, I think it's a bullshit charge to go to trial over and I think it's politically motivated. That said, Patricia appears to be guilty of brandishing, firing pin or not, knowingly or not.

My bet is Ken and Barbie go to trial. They have the cash to do it. They have top shelf representation. They're lawyers so they know the game. The DA is looking at an expensive and time consuming jury trial with a doubtful outcome. It's more likely she'll cut and run to save her career rather than risk a high publicity potential loss in court over this. All that needs to happen for this outcome is the MSM quietly drops the story so Gardner's ass is covered.

Looks like they'll have to do so unless they take a plea. As stated above, I think Patricia is guilty of brandishing, but these charges reek of politics just like the Zimmerman trial.

The problem for the DA here is getting anyone into the courtroom as a witness. She'd have to find people that were among the protesters to do that. Then she'd have to vet them to ensure they aren't losers, don't have a record particularly one with a violent crime in it, and make sure they are coherent on the stand. That's a tall order in this case.
The DA can't claim the mob was in fear for their safety. That amounts to hearsay. She can't show video of that. That might work if the mob had fled in terror, but they didn't. They engaged the McCloskey's in an argument and shouting match. They calmly walked by.
The DA doesn't have much to work with from the "feared for my life" angle.

LOL. Good post. Agreed which is why I think someone above the DA's paygrade directed charges be filed.

True. She could be a political animal and just like a rabid dog, not give a $h!+ about that. That will be a costly loss however just as it was for the DA in Baltimore in the Freddy Grey cases.

I think the decision to prosecute came from above the DA office just like in the Zimmerman trial. This could be a career killer.

But wait -

If the gun wasn't operational, what would be the purpose of brandishing it at people protesting?

To scare the shit out of them which is stupid in case one of them started shooting in self-defense. An unloaded gun is a paper weight...which is why it's stupid to brandish an unloaded or intentionally inoperable pistol.

They broke a law by brandishing their firearms. End of story.

Agreed but this story is getting more attention than it deserves. The arrest and charges are out of proportion to what happened. If shots had been fired, yeah, but being assholes? Even assholes scared of rioters? Seems to be overplayed.

Good thing it didn't end up worse. I mean what if someone carries a gun and they pointed guns at you, threatening you?

I think the McCloskeys were scared to death and overreacted because they're chickenshits. Who gives up cover if they think they're being attacked? They would have been safe inside with the windows open and positioned to cover a wide area of fire. Out on the lawn screaming? That's just asking to either get shot or have your gun taken away and beaten with it.

I think they were very concerned. So concerned they went nuts.

Yeah but I was talking about T. A. Gardner. He claimed that the "mob" wasn't concerned. In the video, some can be heard (so they tell me) cussing at them and telling them to calm down.

I have no doubt words were exchanged. As the Prosecution and Defense gather their evidence, I'm sure more video will surface to flesh out what everyone was doing and saying.

Well, we know it wasn't the state attorney general or his office. He's come out saying the charges should be dismissed.

Most likely the city or Mayor. Maybe the Governor, but that could be a problem for the State AG unless he doesn't give a shit.

That's hardly "fear for your life" talk. That's the standard the DA has to meet. Not "I didn't like them holding guns..."

That's fear for your life stuff...

Question: where were the couple when someone opened the gate the night before to let in the first demonstrators?
