Staying in the Capitol and proceeding to enter the Senate chamber is the felony. If he had left earlier, he probably would have only had a misdemeanor.

It is the defense that normally asks to put off trials to give them time to investigate, look at the evidence, and generate a defense. In fact, he got off easier than the majority of first time offenders since the normal sentence for a felony such as this is 15-20 months and he only got 8 months. I guess white privilege has its advantages.
