Israel Forces A Palestinian Family To Demolish Its Two Homes In Occupied Jerusalem

A Palestinian family was forced, Friday, to demolish its two homes in Sur Baher town, south of the occupied Palestinian capital, Jerusalem, in the West Bank.

The family had to demolish its own homes after the City Council in occupied Jerusalem, informed it that if it does not demolish the properties, the city would carry the demolition out using its workers and equipment, before billing them for the costs in addition to a fine of 200.000 Shekels.

Four out of five children in the occupied West Bank and East Jerusalem whose homes have been demolished by Israeli authorities say they have lost faith that anyone can help or protect them and feel “abandoned by the world”, child rights organisation Save the Children has found.

The report published on Monday comes as Palestinians living in the Sheikh Jarrah and Silwan neighbourhoods of occupied East Jerusalem face expulsion from their homes to make way for Israeli settlers, pending decisions by the Israeli Supreme Court.

Israeli house demolitions rendered nearly 1,000 Palestinians homeless last year

Almost 1,000 Palestinians lost their homes due to illegal Israeli house demolitions in 2020, according to the United Nations.

Israel demolished 849 buildings belonging to Palestinians last year resulting in 996 people losing their homes – 489 among them children.

In the worst year for home demolitions since 2016, 664 demolitions took place in Area C of the West Bank which is fully controlled by the Israeli authorities and makes up around 61 per cent of the territory.

Another 175 homes were destroyed in occupied East Jerusalem with the remaining eight buildings scattered around Area A and B of the West Bank.

The largest single incident took place on November 3 in Humsa Al Bqai’a resulting in the destruction of 83 structures (around three-quarter of the community), displacing 32 adults and 41 children.

Destruction of private property is clearly prohibited under international humanitarian law, notably the Fourth Geneva Convention.

Even following the transfer of parts of the West Bank and the Gaza Strip to the Palestinian Authority as part of the Oslo Accords, Israel remains the occupier of the Occupied Territories. As the occupier, it must comply with the duties of an occupying state, and act in accordance with the laws of occupation.

Hostilities are taking place in the Occupied Territories, but these events do not justify Israel’s avoidance of its duties as the occupier, as if the occupation had ended. [...]

The occupying state must also protect the civilian population’s property. Article 46 of the Hague Regulations provides that private property must be respected and that it cannot be confiscated. Article 53 of the Fourth Geneva Convention provides that the destruction of property by the occupying state is forbidden, “except where such destruction is rendered absolutely necessary by military operations.” Because the occupier has special obligations toward the civilian population, it bears an extremely heavy burden of proof that the injury was necessary. Article 147 of the Convention provides that, “extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly” is a grave breach of the Convention.

Israeli occupation authorities demolished on Saturday a Palestinian house in the Arab city of Lod, in the central district of 1948-occupied Palestine, under the pretext that it was built without a permit, according to local witnesses.

Israeli police forces accompanied by bulldozers raided Al-Mahatta neighborhood in the city and closed off all roads leading the targeted house, which belongs to Palestinian citizen Ibrahim Touri, before embarking on with the demolition, according to WAFA news agency.

The forgotten mass destruction of Jewish homes during ‘Kristallnacht’

Every November, communities around the world hold remembrances on the anniversary of the Nazis’ brutal assault on the Jews during “Kristallnacht.”

Also known as “the Night of Broken Glass,” it’s one of the most closely scrutinized events in the history of Nazi Germany. Dozens of books have been published about the hours between Nov. 9 and 10, 1938, when Adolf Hitler and his propaganda minister, Joseph Goebbels, decided to unleash violence against Jews across Germany and the annexed territory of Austria with the aim of driving them out of the Third Reich.

Most accounts tend to emphasize the attacks on synagogues and shops, along with the mass arrests of 30,000 men. A few note the destruction of Jewish schools and cemeteries.

Attacks on Jewish homes, however, are barely mentioned.
