There are legal requirements for what an appeal can include. It can argue whatever it wants but there are consequences for the person filing the appeal if they argue beyond what is legally allowed. Are Trump's lawyers willing to lose their law license for him?

Appeals that argue "whatever they want" are not likely to be successful. They need to have a legal basis and a likelihood of winning. Arguing that your client refused to testify and should have been allowed to is not a legal basis for appeal.
