Only people that don't owe their allegiance to another government and are born in the US are citizens. Illegal Aliens owe their allegiance to another government and so do their offspring. After delivery the woman and the baby return to China to live where they owe their allegiance to China. Elk's parents owed their allegiance to another government and because of that the SCOTUS decided Elk owed his allegiance to another government and that disqualified him for citizenship.
