Of course I do. Do you know that a SUB contractor is STILL a contractor. Do you know that if the sub contractor has not been payed by the General contractor that the subcontractor can go right to the owner of the home. project, ect ect and demand the money or put a lien on the property?
Yes but you clearly do not understand how this process works. Here is the key part you do not understand...

"...has not been payed by the General contractor..."

That is something that HAS to be filed and litigated in a court because sometimes the 'trades' have a proper claim and other times they do not and yet still want to get paid. Especially on a project where they might believe if they create media noise they might get paid even if they do not deserve it.

Anyone who understands construction and trades knows how this works and clearly you do not.
 
If a General contractor hires me as a subcontractor to say put in the HVAC on a project and the property owner paid the General but the General failed to pay the sub the sub can then put a lien on the property. When that happens most property owners will then pay the sub direct to quash the Lien and then sue the General.
 
The "property owner " would then pay the sub contractor and sue the general contractor for the amount paid out plus court costs. The debt doesn't just go away and the sub just has to eat it...LOL Not how it works,...the property owner still got the value of the subcontractors work,....they must be paid.

No, in fact Property Owners do NOT just jump to pay the sub contractor and then sue the general contractor because if the General Contractor was correct in not paying that trade (did they complete their work per the contract???) and if the general contractor plans to fight the trade in court, if they sue, and if they win, but the Property owner has paid the trade then the property owner eats that cost and the trade gets paid for work undone.

The process demands the Contractor and Sub contractor and trades run the process thru courts to get judgments to ensure things get settled properly.

Ok.........:rolleyes: Normally how this works is this.............GC gets paid a draw that covers their own, plus all subs involved,...GC uses the plumbers draw money to pay say the electrician, plumber gets screwed until next draw. Next draw the GC uses the drywallers money to pay the plumber to shut him up for awhile.....Then upon completion, the last sub that didn't get paid gets SCREWED because GC frittered away all the dough. This is how it has gone since Moses was in diapers.

I pointed out on the last thread about this that Obama doesn't hire or pay the subcontractors.

The subcontractors are hired and paid by the contractors. They need to sue the contractors if the subcontractors got stiffed.

It is exactly why Stone should get no where near this process.

If you have :

- Property Owner
- General COntractor
- Subcontractor
- HVAC project

And a dispute breaks out between GC and SubC then ABSOLUTELY NOT does the Property Owner just jump in and pay the sub contractor without proof of the sub contractor claims being leigt.

Many times the reason the Sub trade has not been paid is legit and the ST would lose in court and yet Stone is saying 'jump the process and pay them all regardless'.

That is just dumb and Stone thinks that as he is dumb and has no business near a construction project nor speaking about them.

And what happens if one of hundreds of sub trades on a job materially fails to deliver on his contract? If they cause delays and cost over runs that hurt the job overall?

That happens all the time on big jobs.

So in your understand you are saying "just pay that person regardless and if the GC won't the owner should jump ahead and just do it".

Right? That is how you think jobs SHOULD and DO proceed.

Yup.

And if the SC wins and the Contractor cannot pay for whatever reason then the HomeOwner can be held liable even if he did pay the Contractor fully.

But what Stone thinks is the proper path is madness. Owners cannot and should not jump in prior as that then allows sub trades to basically get paid even if they did none of the requirements, cost the site money and time, and would fail in court to win a judgment.

Actually I am aware of all of that, but it's not as straight forward as that. First have to sue the contractor.
