Yup, there is no chance for a Constitutional amendment by either party based on how bipartisan that needs to be both in Congress and amongst States.

The magat path to getting that change is simply to have the radical Supreme COurt amend the Constitution from the bench as they did give Trump and future POTUS immunity, something that Congress would need to do a full Constitutional amendment to achieve.

The good news is that the magats would need an even more extreme bench of radical right wing Justices and while Alito and Thomas will almost certainly be replaced by even more radicals (Aileen Cannon and Emil Bove) who will be able to serve for 30+ years, that will not change the numbers game as Thomas and Alito were already guaranteed magat votes.

If the Dems gain the House and Senate it is imperative they expand the court to 13 Justices and place 4 Justices right away. the history of the SC is that is what typically expanded to match the Circuit Court expansion and they have been up to 13 for a long time now. And it is clear the case load on the 9 is too high with many important cases unable to be heard.

That report has been withdrawn as mistaken. No announcement on retirement yet but it is expected.

Both Alito and Thomas will face immense pressure to retire BEFORE the MT's just in case the Dems take the House and then they can use the Mitch precedent to not confirm any Trump nominees.

i'm really hoping they both hold.

The only reason they might leave is fear the Dems take the Senate, so i am hoping they convince themselves that is a real long shot and not to act based on it. Then i want the Dem to 'Garland' any Trump nominees if they end up having to step down while the Dems control the Senate.

I want to watch the magats cry and scream about why it is wrong for the Dems to not give their nominees their process and why it is 'different' than what was done to Garland, which they will claim was proper.

Kavanaugh's concurrence gave a little light to a path for future success if this issue comes back. He was trying to narrow the amendment to say it was really just about 'slavery' and not protections for all others.
 
If an act of Congress can grant citizenship to all Indians can an act of Congress limit citizenship to people with at least one American parent?
