That is just Presentism. Punishments for serious crimes, even minor ones, were generally far more brutal worldwide than they are today. Applying today's morals and standards to the distant past is just presentism, nothing more. Yes, Dillion's position wasn't much better, but you are doing yourself no favors here by trying to use presentism as whataboutism.
