Only the Prosecutors present to the judge with no defense questioning it so Judges have to trust what is presented and decide based on that.
The Trump DoJ uniquely has been caught lying and misrepresenting facts to get warrants and indictments which then fall apart immediately after as the defense exposes what they did and they get laughed out of court.
