we should probably frame the argument constitutionally. I think equal protection would be a good argument. If we decline to prosecute because of the damage it would do to families then other people who have broken the law should be entitled to that same protection as well. Which means it would not matter if you commit robbery or murder or anything else as long as you have an "anchor family" you cannot be prosecuted.

True. And the left uses this too. To say that the crime bill broke up black families. LOL! Not the fact that they are committing crimes, no that's fine. Its the laws fault for enforcing them... Or some such nonsense.

It has become a racket for many...Feds Raid California 'Maternity Hotels' for Birth Tourists

Southern California apartment complexes that doubled as "maternity hotels" for Chinese women who want made-in-America babies were raided early Tuesday, capping an unprecedented federal sting operation, officials said.

NBC News was on the scene as Homeland Security agents swept into The Carlyle, a luxury property in Irvine, California, which housed pregnant women and new moms who allegedly forked over $40,000 to $80,000 to give birth in the United States.

"I am doing this for the education of the next generation," one of the women told NBC News.


None of the women were arrested; they are being treated as material witnesses, and paramedics were on hand in case any of them went into labor during the sweep.

Instead, the investigation was aimed at ringleaders who pocketed hundreds of thousands of dollars tax-free to help Chinese nationals obtain visas and then pamper them until they delivered in an American hospital at a discount, court papers show.

"It's not necessarily illegal to come here to have the baby, but if you lie about your reasons for coming here, that's visa fraud," said Claude Arnold, special agent in charge of Homeland Security Investigations for Los Angeles.

All told, the feds raided 20 locations in Los Angeles, Orange and San Bernardino counties, targeting three competing birth tourism schemes, officials said. The suspected operators have not been charged but are being questioned.

The organizers who allegedly ran the Carlyle site, Chao Chen and Dong Li, used a website to drum up business, touting the benefits of a child with U.S. citizenship: 13 years of free education, low-cost college financial aid, less pollution, and a path for the entire family to emigrate when the child becomes an adult.

These two legal principles have existed in human law for millennia.

They're "illegal" aliens because we say they are.
Straighten up the work visa issue, and we can have migrant workers harvesting our crops and keeping our food prices preposterously low for the foreseeable future.

I don't disagree with a worker visa program. But we know how that gets abused. They end up staying, then the left ends up arguing for their amnesty.

Becomes de facto amnesty.

why is there special protections for them? If a citizen father commits robbery or murder then do you now say he cant be jailed because he has a citizen son that will suffer? What about a white collar criminal? Surely punishing them would lower the standard of living of their family. Should they be spared? Should anyone be punished at all given that their family will usually suffer ill effects?

There is a law and there is a prescribed punishment for breaking that law.

If you believe the law is unjust then your remedy is to change the law not to ignore it.

It's us picking the rules, not them. If the suggestion was to have THEM pick the rules, I might agree with your anarchy thing, but it's not.

We get to decide what to do.

And, I'd point out that we have amnesty programs in the US for just about every last illegal act we have on the books. We even have such laws for debt. Every state has such laws, and they are all surprisingly similar.

agreed...all bank robbers with children under the age of ten should be pardoned......

the children didn't do anything but be born. whose fault is it, that our politicians are not competent enough to actually solve our illegal problem on a permanent basis and generate revenue at the same time.

thats true of any situation. If your dad kills someone and you lose out on time with him you didnt do anything but be born. Same with robbery theft or pretty much any situation requiring punishment.

The remedy you want is to change the law not to refuse to enforce it.
