All of the Strait is within the territorial waters of Iran and Oman. Both Iran and Oman claim the standard 12 nautical mile territorial sea under international law (UNCLOS Article 3, which reflects customary law even for non-parties).

Because 12 + 12 = 24 nautical miles > 21 nautical miles, the territorial seas of the two countries fully cover the strait at its narrowest point and overlap in the middle.
