Come January 6th, 2021 Vice President Mike Pence will be presented with the sealed certificates containing the ballots of Presidential electors.


At that moment the Presidency will be in his hands.


And there is nothing stopping Pence under the (PLENARY and UNAPPEALABLE) authority vested in him as President of the Senate, fromdeclining to open and count the certificates from the six (6) disputed states.


Pence, as I say has an ABSOLUTE, "plenary and unappealable" authority to do this, should he so decide.


If there are (as more than 70% of Republicans believe) certificates from non-electors appointed via voter fraud, why should he open and count them ?


If the votes of all seven (7) contested states are registered as ZERO, President Trump will have 232 votes and Pop Biden will have 222 votes.


Per the 12th Amendment: "The votes shall then be counted(.)...The person having the greatest number of votes for President, shall be President."


PS: Thomas Jefferson, one of America's most revered founding fathers, only became President because he used his unilateral power as President of the Senate to open and count the Presidential votes in his own favour.


WHAT IT MEANS IS THAT DONALD TRUMP WILL BE INAUGURATED FOR HIS SECOND TERM IN OFFICE on 20th January, 2021 - YAAAAAAY !!!!! While it is Constitutionally within his power to do so and it would take the decision away from the feckless John Roberts, I really can't see Pence doing it.

I hope he does. It would be an in your face move. I just wonder if Pence is really that loyal to Trump. He has been a faithful soldier thus far, but this might be a bridge too far for him.
 
I'm just on this one to set the record straight. Jefferson was a state's rights, limited and enumerated const. powers, slave owning, pro farmer anti-federal banker guy.
A Jefferson card is inappropriate. Unless maybe Jefferson Davis or George Jefferson.

It is not, repeat not, "Constitutionally within his power to do so". The Constitution empowers the Vice President to supervise the counting of votes; it grants him no power to change votes in any way. Had you given this any thought the absurdity of the Founders enabling an elected official to change on his own the outcome of a Presidential election might have occurred to you. The post that opens this thread along with yours are tributes to ignorance. The election of 1800 ended in a tie of electoral votes and Jefferson was elected on a late ballot in the House of Representatives, not by votes he selectively counted himself.
