Legal experts say a case could be made that Trump falsified business records by logging Cohen’s reimbursement for the Daniels payment as legal fees. But that’s only a misdemeanor under New York law — unless prosecutors could prove he falsified records to conceal another crime.

Mark Pomerantz, who led the investigation under then-District Attorney Cyrus Vance Jr., wrote in his recent book “People vs. Donald Trump: An Inside Account” that in 2021, he looked into whether Trump could be charged with money laundering or if Trump had been somehow extorted.

David Shapiro, a fraud risk and financial crimes specialist and former FBI special agent, said a potential case against Trump could be “especially difficult” when it comes to proving his intent and knowledge of wrongdoing.

“He’s loud, he’s brash, so proving that he had specific intent to fraud, one is almost left with the idea that, ‘well, if he has that specific intent of fraud, he has it all of the time, because that’s his personality,’” said Shapiro, a lecturer at John Jay College of Criminal Justice.

The Manhattan district attorney’s office has declined to comment on the investigation.

It has nothing to do with the left. It is a legal problem that Trump's lawyer got a 3-year sentence for. The trial frequently talked about person 1, who was Trump. Trump broke the law, again.

The Daniels case is more about campaign finance regulations. Same for the other woman he bribed.

The article indicates it might be difficult to prove past a misdemeanor conviction.
 
Depends considering that Michael Cohen spent a year inside, hard to argue he deserves more time that the principle.

Cohen was convicted in 2018 of lying to Congress, tax evasion and other charges relating to the payments to Daniels and other women. He served three years in prison.

Fits of spittle frothing? So you can see what they look like? The fact is Trump cannot win the case of payoffs, But he will likely plead to a misdemeanor. That would bother normal voters, but not Trumpys. However the other cases are far more dangerous. I was able to type that with little emotion. It is a fact.

That's the FEC, not the State or city. Different jurisdictions. Had Trump been convicted by the FEC, then double jeopardy may come into play. It's up to the lawyers to figure out.

My bet is it never makes it to court. I have no love for Trump. The guy's an utter asshole, and far too full of himself. That's what makes him so off-putting. People who hate the guy (as opposed to people like me that just wish he'd go the fuck away) have been trying to nail him on something for decades, but haven't succeeded. This is just another nothing burger.

It is difficult for me to imagine how anyone can regard a person of Trump's character - shameless liar, self-obsessed and abysmally ignorant - as fit to be President of the United States.

Nevertheless, around one third of citizens apparently do. It seems they ignore all of the above because he tells them what they want to hear. Is this what a once-great country has come to?
