It's Supreme Court Monday!

Look how small Trump's hands are compared to theirs!

Where is the evidence the constitutional framers were "textualists"or "originalists?"

In totality the constitution as a body of law is as brief as it is vague. That leads me to believe that, as a whole, the original intent was not
to create a document of governance for strict construction. I could go all in with textualism if the document was a form of behavior code or set of laws.
But it does not seem to be that. It is a description of the basic composition and mechanics of the federal government, vis a vis individuals, states and other countries.

The original intent is thus likely to have been for broad and loose interpretation of its ideas as applied to specific cases arising thereunder. You can't apply a broad or vague idea strictly.
So paradoxes abound. An example less likely to inflame the hot tempers of the retarded right and therefore a suitable teaching example for them would be in the area of the first amendment.
A strict constructionist might argue an absurdity, that speech, or assembly, or press means those disjointed specific items like a list, and that therefore the government can prohibit
any other type of expression. But the totality of the passage conveys an intent to prevent the government from stifling human expression. When things the framers said convey an idea
but back then they lacked the modern context, the broader idea should be applied to the new thing. That would effectuate original intent.
I understand perfectly. What's even easier to understand were the violent protests by extreme leftists against the 1st amendment. At least they showed a little manhood and got out of their safe rooms.
On second thought, perhaps a bit much to expect these hillbillies to understand a word of this complex thought, however.
No wonder you couldn't pass Remedial Math I. Nothing complex about that.

with the exception of a handgun in the home for self defense, what other gun law has been overturned by the courts for being unconstitutional?

1) some lib'rul states would ban guns if they could
2) they can't because of the constitutution
therefore
3) the constitution stands in the way of how some states would address the issue of gun violence.......

Democrats up for election in Red meat states will vote to confirm Trumps pick, and may even put it over the simple majority threshold, which is the real beauty of this process, watching phony liberals operate to save themselves.

I'm pulling for the chick by the way

as i said, short of an outright ban, how do the courts protect the 2nd Amendment? answer is, they don't. since McDonald, no gun law enacted by a state or municipality has been overturned

From the choices I have heard floating around Ketnledge is my first choice and Barrett the woman is my second

If so, he will have appointed something other than a textualist.

Let me guess, every single gun control measure is going to be subjected to strict scrutiny, while pretty much the entire 14th amendment is suddenly going to be rational scrutiny (besides the sections they use to apply the 2nd). Oh yeah, also any measure we use to fight racism is now racism. And Republicans are going to pass a bunch of laws that, by pure chance, totally unintentionally, just happen to have a side effect of massively reducing the number of minorities voting, and the supremes are just going to sit back and take them at their word that they meant no ill intent whatsoever, the only emotion in their heart of hearts was a desire to approve the most rational and suitable voting laws possible.

Great textualism.
