Heads up Teabillies - the gubmint's a comin for your small dick compensators

you would NEVER get a jury of 12 people to agree that you were in imminent danger from someone waving a nazi flag. you would not have justification, but I implore you to take action against someone waving a nazi flag and present that defense to a jury

This is why it's a jury of your peers (fellow American citizens) and not 12 fucktards like LV666. Even when one or two slip through the cracks onto the jury panel, the worst that happens is a guilty man goes free.

Like I said, Flash, your position is that you only deem them a threat after they've already acted, not before even though they are telegraphing to you precisely what they want to do and achieve.

That is the position of the law at the federal level and all fifty states.

It is my position that if a person can go around killing people because they claim they are threatened by their political views this country is going to see a lot of killing.

Muslims will be killed because people think they want to kill infidels
White people will be killed because black people think they are racists
Black people will be killed because they are seen as a threat to whites
Abortion providers will be killed because they will abort babies

Only the most privileged person thinks they have the right to kill others.

Nice hand cannon. He probably would! Personally, I like smaller calibers, say around 9mm. People underestimate that little .22 cartridge. A .22 pistol has been used in many a mass shooting.

When I DO use guns, I'm a fan of using .22's myself... They pack enough punch for what I use guns for...

I have plenty.

I have Stand Your Ground Laws.

That's all the justification I need.

You don't understand stand your round laws. They mean you do not have to retreat if threatened. Waving a flag is not a threat under the law. It includes a "perceived threat" but there is no action on which to justify your perception.

Drejka that killed another guy in (FL?) had been shoved to the ground. He pulled a gun and shot the guy while sitting on the ground.

He was charged with manslaughter because once he was on the ground with his gun the victim was no longer a threat because he was not advancing toward Drejka and had no weapon.

Your desire to kill Nazis is not supported by the law.

So then what is the purpose of waving the Nazi flag?

To tell you what he stands for.

Is a Nazi justified in shooting you because you want to kill them? Do you think that defense would work for that Nazi in court

NAZI: "I was only standing my ground because the poor deceased LV426 wants to kill Nazis and I am a Nazi and feared for my life"
DA: "How do you know LV426 wants to kill Nazis?"
NAZI: "He said so on Just Plain Politics message board"
DA: "Did he verbally threaten you or take any action toward you? Did he point a gun? Run toward you aggressively?
NAZI: "No, but I knew he wanted to so I killed him before he had a chance to kill me"
JURY: "Guilty on all counts"

Victory for LV426. That NAZI got the death penalty.

Yes you can.

You absolutely can.

You don't seem to know much about free speech laws, and that there are no absolutes. You can be prosecuted for incitement. You can be prosecuted for making threats, even if that threat isn't acted upon.

You're not a lawyer. STOP.

As usual, you don't know what 'absolute' means.

The federal government is absolutely barred from passing any law abridging free speech. The States DO have that authority, if and only if it is given in their own constitutions.
Otherwise, the 10th amendment absolutely applies and IS binding on the States.

That's exactly what it is. It's fun, and not so fun at the same time, to shoot. Shooting too many rounds can cause both the wrist and the wallet to hurt a lot.
But fun. One of the best ways to make your hand hurt.
Not a big 9mm fan. Rather have my .45.
Nuthin' wrong with a .45. A good solid caliber and good availability on the ammo. I see you favor larger calibers.
As far as the .22, it's not much to shoot but it's cheap.
It IS certainly cheap! I see you like a good kick in your gun. Me? I like to target shoot, and staying on target through reasonably rapid fire is more important. I figure it's more important to put multiple shots into your target at a reasonable rate than have big kicker for a gun.

Enjoy your guns! The big un's can be fun to shoot!

No, we've also changed laws relating to guns people can own or carry.

Illegally. No court, no legislature, no Congress, no President has the authority to change the Constitution.

You are also discussing a murder law, not a gun law. Stop redirecting all the time. You keep losing context that way. The 'stand your ground' law in Florida applies to ALL weapons, not just guns.

No, I wasn't discussing a murder law. I was saying that we can change laws regarding guns, as we have before.

But it is not illegal unless that person shows some proclivity to actually kill somebody.
WRONG. A murder has to actually take place. No murder, no victim, no crime.
There is no conspiracy unless we actually plan that murder.
Planning a murder does not require more than one person. No conspiracy required.
A conspiracy, by definition, is secret.
WRONG. A conspiracy is often public, such as the conspiracy of Marxism.
So the victim is not aware of the plot against him.
What victim? There hasn't been a murder yet!
And, a conspiracy, is a plan for future action and therefore cannot be "imminent."
Guess what? Conspiracies are not illegal!
If you think you have the right to assault or kill a Nazi why were the people being prosecuted for attacking Nazis in the stories I posted?
Assault. Battery. Murder. They committed the crime.
As those stories revealed, some of the people were not really Nazis. If I "think" you are a Nazi am I still justified in killing you because I think I am in danger although I am wrong?
The main point is that you can never harm someone because of their political views. No views are a threat to anybody.
They are, and you can be prosecuted for them, but not on the charge of murder.

contrary to popular belief, just because the government has done something does not mean it's been constitutional. we haven't had a government that operated within the confines of the constitution since the early 1800s

I already told him this. He wants to overthrow the United States and install fascism by oligarchy, using the Courts as that oligarchy.

WRONG. A murder has to actually take place. No murder, no victim, no crime.

I think you missed part of the debate. We were talking about one person urging another to commit murder. If I am trying to persuade you to commit murder I am committing no crime unless you show that you are about to commit that murder. If police stop the murder from happening there is no murder but we can both be charged with possible crimes.

Planning a murder does not require more than one person. No conspiracy required.

True, but I was referring to the post that said Nazis are conspiring to commit murder by their very ideology.

WRONG. A conspiracy is often public, such as the conspiracy of Marxism.

You distort the meaning of the term conspiracy. Marxism is an ideology, not a conspiracy.

What victim? There hasn't been a murder yet!

The person the Nazis are conspiring to murder cannot kill them first in self-defense because he does not know they are conspiring to kill him (because conspiracies are secret).

Guess what? Conspiracies are not illegal!

They are if you are conspiring to commit a crime even if it is not completed.

Assault. Battery. Murder. They committed the crime.

My point exactly. The poster claimed you can kill a Nazi because it would be self-defense because their ideology favors killing others even if they are just waving a Nazi flag and not taking any threatening action.

They are, and you can be prosecuted for them, but not on the charge of murder.

I agree if you are talking about the person who killed a person they mistakenly thought was a Nazi.

But, if you were claiming that "the main point is that you can never harm someone because of their political views. No views are a threat to anybody" is wrong I totally disagree. Holding any view is not a threat in itself. As the courts have made clear, "mere advocacy" is protected speech. I can advocate the violent overthrow of the government, sex with children, or the killing of all Jews. All of those are protected speech.

I am aware of your debate. You cannot be charged legally. There is no victim. There is no crime. Do you know what 'habeas corpus" means?
True, but I was referring to the post that said Nazis are conspiring to commit murder by their very ideology.
They are. Nothing you can do about it.
You distort the meaning of the term conspiracy. Marxism is an ideology, not a conspiracy.
It is both. It is two or more coming together with the intention of breaking the law. Conspiracies need not be secret.
The person the Nazis are conspiring to murder cannot kill them first in self-defense because he does not know they are conspiring to kill him (because conspiracies are secret).
Some are, some aren't. Killing Nazis because of their conspiracies or ideology is illegal. It's murder.
They are if you are conspiring to commit a crime even if it is not completed.
Nope. To convict someone this way, you have to show they are actually preparing for the crime, such as gathering weapons, bombs, etc. The conspiracy alone doesn't cut it.
My point exactly. The poster claimed you can kill a Nazi because it would be self-defense because their ideology favors killing others even if they are just waving a Nazi flag and not taking any threatening action.
He is wrong. We agree on that. We both agree it's murder to kill a Nazi this way.
But, if you were claiming that "the main point is that you can never harm someone because of their political views. No views are a threat to anybody" is wrong I totally disagree. No, they aren't.

The 1st amendment applies ONLY to the federal government. The States can regulate what they want, subject to their own constitutions.

That said, most State constitutions have similar wording. It is the State constitution that prevents the State from curtailing your speech, not the federal Constitution.

States have in the past and still can have State religions, subject to their own constitutions. Several States are considering such a change.

I am aware of your debate. You cannot be charged legally. There is no victim. There is no crime. Do you know what 'habeas corpus" means?

You are not familiar with crimes such as conspiracy to commit murder or solicitation of murder. There is no victim but the plan to kill the person is a crime in itself. Many times some overt act must be committed (buying a gun) but not in all jurisdictions.

contrary to popular belief, just because the government has done something does not mean it's been constitutional. we haven't had a government that operated within the confines of the constitution since the early 1800s

Which is why muh constitution is nothing more than a propaganda tool.
