I think you missed part of the debate. We were talking about one person urging another to commit murder. If I am trying to persuade you to commit murder I am committing no crime unless you show that you are about to commit that murder. If police stop the murder from happening there is no murder but we can both be charged with possible crimes.

Nope. To convict someone this way, you have to show they are actually preparing for the crime, such as gathering weapons, bombs, etc. The conspiracy alone doesn't cut it.

But, if you were claiming that "the main point is that you can never harm someone because of their political views. No views are a threat to anybody" is wrong I totally disagree. Holding any view is not a threat in itself. As the courts have made clear, "mere advocacy" is protected speech. I can advocate the violent overthrow of the government, sex with children, or the killing of all Jews. All of those are protected speech.

The 1st amendment applies ONLY to the federal government. The States can regulate what they want, subject to their own constitutions.
That said, most State constitutions have similar wording. It is the State constitution that prevents the State from curtailing your speech, not the federal Constitution.
States have in the past and still can have State religions, subject to their own constitutions. Several States are considering such a change.
