Man Shot by Police in Kenosha Was Wanted for Sexual Assault "Fleeing felon rule"

Isn't deadly force suppose to be used as a last resort???? I saw the video of this incidence on ABC news, and the video clearly showed that there were nonlethal options that the police could have used., for one thing there were two officers for one guy.

Who said it was a last resort

When are you joining the police force so you can show everyone how it’s done.

Or maybe these new social worker jobs that are supposed to replace the po po?

Sometimes it is the first resort

Don’t start none. Won’t be none

By the felon defying the cop’s orders at gunpoint and then going into his car where the cop could not see what he was doing or going after he made himself a credible threat that had to be neutralized. Even if he didnt have a gun in the car. A 4000lb car is a deadly weapon

WANTED FELONS are not innocent

Indeed.

If he had a rape charge and priors he was looking at double digits in prison. Add in a history of violence and he would go to a maximum security facility on top of that. Probably not what he wanted to do...

The penalty for 3rd Degree sexual assault is not "double digits". It's 5 years or less. Even if he had violently raped a child on live television it doesn't justify a street execution.

Third Degree Sexual Assault: A person can be imprisoned not more than five years or fined not more than $10,000 for committing third degree sexual assault. This includes:

Sexual intercourse with a person without consent of that person, or
Sexual contact with intentional penile ejaculation with a person without consent of that person.

Did the cop know who he was before he shot him?

It doesn't matter, but I think he did because they were trying to apprehend him due to an open warrant.

This entire tragedy boils down to whether or not it was a lawful use of deadly force. The video casts a lot of doubt that it was.

The police have to make split second, life and death decisions.

They want and deserve to go home alive at the end of the day.

If this sexual assaulter had obeyed the lawful police commands and not either reached into his car or tried to flee in his car, he would not have been shot.

No sympathy for this thug.

He is no longer sexually assaulting.

It does matter, they'd know if he was violent or not, or if it's just some Joe Schmo. Why were they stopping him in the first place (I don't know)?

I am unfamiliar with the intricate details of this incident, but what I've seen, 7 rounds in the back was overreaction.

No, it doesn't matter per shooting him in the back. He could have had an open warrant for too many unpaid traffic tickets and he would have still been arrested. The warrant is the reason why the police were trying to apprehend him, not the justification for pumping seven rounds into his back.

Watch the raw footage video. Blake's leg can be seen as he tries to get in the car. The police officer grabs his t-shirt then shoots him three times at a spaced interval followed by 4 shots in quick succession. You probably have a carry permit and have been instructed in lawful shootings. Blake slumps at the first three rounds and was down when the police officer quickly pumped four more bullets into him. This does not look good for the office in question. The second officer didn't even appear to have his weapon drawn until the shooting started. The third officer was covering the back of the car by the cruiser. She doesn't appear to have her weapon drawn either until the shooting started.

The other two officers should be found blameless for this shooting since it happened so quickly unlike the officers who watched the lead officer kneel on the suspect's neck for 9(?) minutes and did nothing. The shooting officer's fate remains to be determined by the evidence.

Thanks for the update. What was found in the car will play a role in this, or what was accessible. If nothing, he's in pretty deep shit.

That's why he wanted to get away, no doubt. But 7 rounds in the back while trying to enter a vehicle is excessive. A non-lethal crippling shot could have been made at that range even IF the officer could see a weapon. If he could see one, he has a semi-automatic handgun to take any further shot. Were there other officers there with guns drawn? Did they already identify him and know of his background?
If he tried to drive away, other officers could block him with a cruiser if he tried to leave. There would be ample time until he started it, put in gear and started moving.

You miss the point. The officer was trained to shoot center mass and fire three rounds. He did this twice which given the excitement of the situation, adrenalin up, that sort of thing would be understandable. Officers ARE NOT trained to shoot to wound. They are taught to stop the action. That is, you shoot, assess the situation (usually vaguely in training) then fire more rounds if necessary.

The problem with him getting in a vehicle is two-fold. One, you can't fire at the vehicle unless the guy in it is actively shooting at you or using the vehicle as a weapon. That complicates engagement. Second, you don't want to engage in a high-speed chase or let the suspect get out of sight. Both greatly complicate things. Add to that, at that moment, none of the officers was in their vehicle and none were close to their vehicle. That would mean the suspect would likely get away and out of sight. Reestablishing contact is problematic. They wanted to keep him at the scene.

My pleasure.

Nothing has been reported. If it was clear Blake was going for a weapon, that information would undoubtedly have been released by now in order to quell public concern. It hasn't been, which is a curiosity to me because it could get very, very bad for the shooting officer by next week. Again, I think the other two were properly doing their duty.

Jacob Blake, the 29-year-old black man shot by police in Kenosha, Wisconsin, on Sunday, was wanted on charges of sexual assault, among others, according to the Associated Press.

The AP reported Monday:

Online court records indicate Kenosha County prosecutors charged Blake on July 6 with third-degree sexual assault, trespassing and disorderly conduct in connection with domestic abuse.

No we know why the POS wouldn't comply with police, if there was a gun in his car u can bet if he got his hands on it he would have used it

Gun History and wanted for third-degree sexual assault RAPE (felony)

Fleeing felon rule

At common law, the fleeing felon rule permits the use of force, including deadly force, against an individual who is suspected of a felony and is in clear flight.[1]

According to the article he wasn't "wanted" or "fleeing", he had already been subdued and charged for the alleged offense. Also according to the article, the first arrest was of a 24 year old, and the guy shot by police is 29, and Breibart didn't bother to find out if they are different people because "the line was busy". This is journalism in Trump world.

Please check my hearing and ability to count, it looks/sounds like 3 spaced apart shots then four quick shots (really two quickly then another two quickly). Anyone familiar with firearms certainly knows the sound difference between an aimed shot and "just busting caps".

Much worse than that, of course, is where in those seven shots, did Jacob Blake cease to be a threat to anyone? You should know that if it was shot 6 or 7, good for him. If it was shot #3 that rendered Blake incapacitated, as the sounds indicate and the position of Blake's leg under the car indicate, then the four remaining shots make the police officer guilty of assault with a deadly weapon. If Blake dies, then it's murder. This is all given that the police officer was justified to shoot in the first place. I don't think he was but if there was a weapon in the car, it could be argued he was justified.

This information is taught to those who carry a weapon, be it for work or as a personal carry permit.

People should be able to shoot rioters as well. To protect their business since it is their livelihoods.

Indeed.

The black retired police captain in St Louis was shot and killed defending his business.

The far left loons ignore this because it was a black shooter.
