Wrong! Garcia was found deportable and given a final order of deportation. Biden's administration, in over 4 years, did nothing to carry that order out. Garcia's immigration lawyer(s) tried a relatively common ploy of applying for asylum after that order was issued. The US immigration system is such that the asylum request must be heard regardless of the final order of deportation. Lawyers know that and use it to drag out the inevitable.
Trump came into office and carried out the order of deportation sending Garcia to El Salvador. Boasberg, the first judge involved in this, and who clearly hates Trump, issued an immediate order to return Garcia to the US setting off the shit storm of stupidity that followed. At least 2 other federal judges, possibly 3, jumped in to further turn this now clusterfuck into an argument why they all should be fired.
Trump's DOJ piled on with new charges just because as a knee jerk reaction to the imbecility of the courts. This isn't a one-sided thing. You have Trump hating judges, along with several that aren't that sharp, dealing with a vindictive DOJ out to get the judges, not Garcia. Garcia is just a political football being pummeled by the legal system at this point.
