Finding: Mr Pretti’s death was a homicide

That is not the location of the gun
Are you looking for a gun? I'm guessing you have a few roadblocks to owning one. Why the interest? I mean, an idiot that doesn't know the definition of murder has little chance of making any point worth considering. You should be focused on nothing but grade school text books, not trying to be Sherlock Holmes, lol. Leave the thinking for those that can think, you've got a long way to go before you should attempt adult conversations. Just trying to help, as usual.

I'm not certain that this shooting will be considered justified when it is all said and done. This one we may actually see in the courts. I watched the agent walk away with his gun, then watched two people shoot him and I am not sure if they were justified. While they may assume he may still be armed even without that gun, both his arms were being held when the bullets started flying and it will be difficult to understand how they thought there was imminent danger.
Yup.

These are hardest cases to get convictions on as juries hate trying to get into law enforcements head and rule they did not have a legit fear, even when it seems they should not.

But in this instance the State must bring this to court and allow a jury to decide. It would be a travesty not to, for many reasons.

First, ICE must know this risk exists from State prosecutors, as they know Federal Prosecutors would allow them to murder with impunity. Even if found not guilty that will make some (most) ICE agents realize there is risk to their actions.

Second, justice demands a jury decide this question.

If this case does not cross into irrational fear or negligent killing then i struggle to see any that would and the defense of 'I was scared' becomes almost absolute regardless of how things play out, and society should not want that.

I watched it again and at the moment the shooting starts both of Pretti's hands are free and neither are pinned. Watch from 27:30 on.

I still don't know where the first shot came from... speculation about it being the weapon removed from Pretti notwithstanding, I wish I knew or could see that first shot.

@Damocles disagrees.

But I think everyone agrees the gun was never handled by him, and was taken by ICE before they executed him.

It simply cannot be enough that he had a gun on him, while he did nothing but act as witness, that then justified the ICE officer crossing the street, assaulting him and then a group attack by ICE for him helping a lady also assaulted by ICE who was violently shoved to the ground

You can hear a gun go off before Pretti was fired upon. That noise there is what makes me wonder if they will be able to call this justified.

Phone in one hand, glasses in another, what was he reaching for? Did his gun go off when the agent tried to clear it? Where was that first shot from? It wasn't from the agents that pulled their guns we can see them, they did not fire that shot.

This should definitely get into a review somewhere.

Trump's thugs have destroyed all the evidence and will claim whatever they want just like they've done up to now.

It's also proof the Trump administration lied from the beginning and is still lying. They cannot be trusted to tell the truth nor to honor their oaths to the Constitution.
