This afternoon, the defense made a last-minute emergency appeal to the Massachusetts Supreme Judicial Court seeking a stay so the judge could inquire into or remove an alleged holdout juror.

Justice Dalila Argaez Wendlandt denied it. Sullivan then formally declared the mistrial and dismissed the jury.

Plymouth County District Attorney Timothy J. Cruz now decides the next step: retry on first-degree murder, reduce charges (which could allow a bench trial), pursue a plea, or drop the case.

Cruz said last Friday that no decision has been made.

Defense attorney Kevin Reddington has said he expects a retrial and is prepared to go as soon as next week, though he has also estimated six months to a year if prosecutors take more time.

A status conference is set for September 29.

Clancy remains at Tewksbury Hospital, a state psychiatric facility where she has been held without bail since 2023.

She is expected to stay there pending the DA’s decision.

If there is no criminal retrial, civil commitment proceedings are likely.
