I chose to use the Ted Cruz term since "riot" does not necessarily involve political goals and insurrection requires proof of intent. Only the Oath Keepers were charged with sedition conspiracy because prosecutors have gathered a lot of their communications (online and during the violence) indicating their intent and preparation. But, you are right in that those charges are difficult to prove. Things like threats, incitement, etc. are all difficult because a history of court decisions requires more than the simple wording of the law.

There was $30 million in property damage. The 769 people being charged with crimes is more than a "few" who got out of hand. Nothing has to get burned to try to disrupt finalizing the electoral votes.

There were weapons involved. One veteran plead guilty to possessing Molotov cocktails, unregistered firearms, a crossbow. Weapons used against the police officers included the barriers, fire extinguisher, stolen police shield, baseball bat, hockey stick, a rebar, a flag pole, pepper spray and bear spray, and stun gun. Over a dozen police officers went to the hospital with injuries like concussions and bone fractures. There were several charged with carrying firearms on Capitol grounds including an off-duty DEA agent.

I do not think two wrongs make a right; I think Trump et al did nothing wrong. Keep on investigating 1/6 (I think you're gonna get a lot of faulty memories and a lot of diplomatic middle fingers from the GOP witnesses though), nothing will come of it. But there is some seriously evil shit going on with HRC and the turnip-in-chief that should be investigated with at least as much energy and tenacity that is being expended on Trump. And this must be spearheaded by the democrats if it is to have the laxative effect that demonic hoarde so desperately needs.

Thanks for the unsolicited advice, but if I wanted someone I "trusted" in the WH, I'd cast a write-in vote for my old Labrador Retriever. I voted for Bush 41 because he was the former director of the CIA, so I figured he was a crook on SOME level. And I'm pretty sure Trump rubbed elbows with the mob at some point, being in the building trades in NYC. The important thing was, they understood the battlefield.

HRC (and we're starting to see cracks in saint barack's armor here too) and the 'tater head crime family understand a different battlefield. They are in a constant battle to cover up colossal blunders in statecraft, and downright illegal misdeeds. So excuse me if I throw in my lot with the "liar" who took office without a salary and addressed EVERY ISSUE I WAS CONCERNED WITH TO THE BEST OF HIS ABILITY.

I don't think you are guilty because you are on the committee unless they prove you were involved in the conspiracy to commit a criminal act.

Being on a planning committee for something proves you are involved with the thing. The law can get very expansive when it comes to a criminal enterprise. Being involved with the enterprise is enough to be involved with the entire conspiracy.

And remember, there is no need for a criminal level of proof.

They were no longer members, so you are wrong. The legal question was whether they could run again, and they were prohibited from running again based on administrative decisions. That only requires a clerks decision.

There has to be some evidence the committee was planning some type of crime and that he actively participated in that planning. People are on committees and never attended a meeting. I think a criminal enterprise might be beyond the scope of the 14th.

I'm not defending the guy, but I think those who want to see him punished are stretching the law to achieve their desired goals.

They voted to expel those members. You cannot expel somebody who is not a member. Some argued that the states did not have the power to secede and therefore were still part of the Union and members of Congress.

No, there just has to be evidence that some sort of crime was the outcome of the planning, and that "Madison" did not do positive steps to break from the conspiracy. "Madison" is quite proud of his refusal to take positive steps, and hundreds of people have been proven guilty of crimes stemming from his planning.

It would have to be more than "some sort of crime." It would have to be something covered under the 14th Amendment, Section 3, disqualification clause. There is no provision for disqualification on felonies or misdemeanors or other crimes.
 
There have been hundreds of convictions, so I would say the evidence exists.

The convictions have been those participating in the riot or trespassing. The Oath Keepers were charged with seditious conspiracy because they have evidence of them planning and coordinating their actions.

But, I am not aware of any charges (or investigation) of a planning committee involving members of Congress. Who else was on this committee?
