But, you are right in that those charges are difficult to prove. Things like threats, incitement, etc. are all difficult because a history of court decisions requires more than the simple wording of the law.

Being on a planning committee for something proves you are involved with the thing. The law can get very expansive when it comes to a criminal enterprise. Being involved with the enterprise is enough to be involved with the entire conspiracy.

No, there just has to be evidence that some sort of crime was the outcome of the planning, and that "Madison" did not do positive steps to break from the conspiracy. "Madison" is quite proud of his refusal to take positive steps, and hundreds of people have been proven guilty of crimes stemming from his planning.
