Madison Cawthorn, a key speaker for Trump's insurrection, is up for reelection in NC's 13th District but his bid may be disqualified by the 14th Amendment. It's possible that all of the elected reps, including Trump, may be ineligible for election.

Nonprofit organization Free Speech for People, a "nonpartisan, non-profit legal advocacy organization with constitutional law expertise," which is serving as lead counsel in the matter, announced on Monday that the challenge was filed before the North Carolina State Board of Elections. The challenge "alleges that Cawthorn is constitutionally disqualified from public office under the Fourteenth Amendment to the U.S. Constitution based on reasonable suspicion that he helped facilitate the January 6, 2021 insurrection," the nonprofit described in its press release.

The legal challenge brought against Rep. Cawthorn cites Section Three of the Fourteenth Amendment, known as the Disqualification Clause, which states, in part, “No Person shall be a Senator or Representative in Congress. . . who, having previously taken an oath, as a member of Congress . . . to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”

Monday's release adds that no criminal conviction is required under the clause, and that "Cawthorn would be able to seek judicial review of an adverse decision."

I don't believe that Cawthorn, or anyone else in office for that matter, has been tried and convicted of insurrection yet, so all of this is nothing but grandstanding by political entities as they keep striving to divide us

At a campaign event in Macon County, N.C. over the weekend, Republican Congressman Madison Cawthorn (NC-11) backed a disproven conspiracy theory saying, without evidence, that 536 people are being held captive in solitary confinement without bail, and without legal representation by the U.S. government.

Cawthorn said other Republicans and Congressional representatives were unwilling to talk about the alleged political imprisonment because it is, "controversial."

"What's controversial is we have 536 people [who] are being held in solitary confinement for 23 hours out of the day who are not being able to have religious freedoms..." Cawthorn said.

He was responding to questions from constituents following a short speech.

"What are you doing to support the 535 Americans held captured after January 6th?" a woman in the crowd asked.

"Political hostages, make no doubt. So this is something that we are trying to figure everything out about, there are some criminal activities going on..." he said.

A Rolling Stone magazine article says U.S. Rep. Madison Cawthorn was one of several members of Congress "intimately involved" in planning both former President Donald's Trump’s "efforts to overturn his election loss and the Jan. 6 events that turned violent."

Cawthorn spoke at an event on Jan. 6 with President Trump, telling the crowd, "My friends, I want you to chant with me so loud that the cowards in Washington, D.C., that I serve with can hear you — USA, USA, USA." Cawthorn has been an ardent Trump supporter and has made frequent claims of election fraud, despite numerous vote certifications in multiple states that found no widespread fraud.

The Rolling Stone article, published Oct. 24, cites two anonymous sources, one named as a "planner," the other an "organizer" of the Jan. 6 events. The magazine states, "While there have been prior indications that members of Congress were involved, this is also the first account detailing their purported role and its scope."

You need a conviction to go to prison, but office can be denied on a much lower level of proof.

A Constitutionalist understands the 9th and 10th Amendments. You're effectively advocating to overrule those Amendments to impose your autocracy.

Translation: Yes, I advocate murdering children because the US accidentally participated in killing children at Waco.

You are free to use that excuse to murder kids, but you won't get any sympathy from a jury at your trial.
 
There was no Trump insurrection

Cawthorn could claim that the failed insurrectionists were just non-violent elderly people who went to the Capitol to take selfies. That should do it. :)
