North Carolina elections board says it has power to bar Cawthorn from running over Jan. 6
The North Carolina elections board said in a court filing Monday it has the power to bar Rep. Madison Cawthorn (R-N.C.) from running for office over his actions leading up to the Jan. 6, 2021, Capitol riot.

“The State does not judge the qualifications of the elected members of the U.S. House of Representative. It polices candidate qualifications prior to the elections,” the board wrote in a filing to dismiss a lawsuit brought by Cawthorn.

“In doing so, as indicated above, States have long enforced age and residency requirements, without question and with very few if any legal challenges. The State has the same authority to police which candidates should or should not be disqualified per Section 3 of the Fourteenth Amendment,” the board added.

There are election qualification boards that determine things like residence, age, and other similar things. They would assumable be who determines it. These questions have not been brought up in a while, so they are still working out who does.

But we know the standard is not to a criminal case certainty.

Insurrection is not a crime? If it is, doesn't that require beyond a reasonable doubt to be convicted?

A problem with election boards is the differences between the state politics. Identical participation in the riot might result in a person being disqualified in a blue state but not in a red state.

Another question is the law passed in 1898 (and 1872) in which Congress removed the disability imposed by Section 3; or, did that just apply to everyone up to that date?

I understand that. But you are saying he can't run for office because of insurrection/rebellion which are criminal matters.

I'm just wondering how we establish a person cannot run for office because of that clause unless we first establish it was violated. Even if it does not require proof beyond a reasonable doubt, someone still has to establish that criteria. All states do not have election boards.

OJ Simpson was sued for murder, and murder is quite definitely a criminal matter. But, he was sued in civil court, so civil levels of proof are required. So he could be found civilly libel, but not criminally guilty.

A similar division is between levels of proof for running for office as opposed to criminal penalties. The 14th Amendment never intended to limit it to only those found criminally guilty.

I do agree this could be misused, and this might be a borderline case... But there is absolutely no requirement for a criminal level of proof. If "Madison's" only defense is that there is not a criminal level of proof, he is done for.
