However, it upheld a finding by High Court judge Mr Justice Richard Humphreys that the Justice Minister was required to consider the prospective constitutional rights of the unborn when considering whether or not to deport their parent.

The ruling will remove much uncertainty ahead of the referendum the Government plans to hold in May to remove Article 40.3.3, better known as the Eighth Amendment, and to allow the Oireachtas to legislate to regulate the termination of pregnancy.

Delivering judgment in Limerick, Chief Justice Frank Clarke said it was the unanimous view of the court that the unborn does not have rights outside the right to life in the Eighth Amendment. It also found that the unborn was not considered to be a child for the purposes of Article 42A of the constitution, introduced with the passing of the children's rights referendum in 2012.

It is a stupid question, wasn't Thomas' opening question, and didn't terrify anyone, in fact, it was dismissively answered and procedures quickly moved on to Justice Robert's questions

In California, the killing of an unborn child (fetus) is murder and is covered under Penal Code Section 187. The California Supreme Court has ruled that knowledge of the existence of the fetus is not required to convict of murder (People v. Taylor (2004) 32 Cal. 4th 863, 868). There is also a five year enhancement for an injury inflicted during the commission of a felony that results in a miscarriage of a fetus (CA Penal Code Section 12022.9).

What could be argued & not even well is Fetuses have less consciousness.

Only in the minds of fools. Abortions have always been legal in this country since its Founding. Roe simply made it a Constitutional "right". If Thomas does not understand this simple fact he should not be a Justice. And we do have feticide laws.
