On September 15th, 1988, a 13-year veteran of the Dayton, Ohio police department, Patrolman Roger Waller, used his fully automatic MAC-11 .380 caliber submachine gun to kill a police informant, 52-year-old Lawrence Hileman.

On April 10th 2002 Dover Township New Jersey Police Officer Edward Lutes, 42, killed himself after murdering five neighbors. Lutes murdered Dominick Galliano, 51, and his wife Gail, 49 with several shots from an MP5. He also murdered the couple's son, 25-year-old Christopher but the type of gun was not specified. Lutes then went to another home murdering Gary Williams, 48, his wife Tina Williams, 46. Again, type of gun not mentioned.

That's two. Were these individuals in possession of fully-automatic weapons legally?

It was a police officer, Patrolman Roger Waller of Dayton, Ohio, who used his MAC-11 assault weapon to rat-a-tat-tat a police informant. Waller pleaded guilty in 1990 and got 18 years.

The police, you see, can have fully automatic weapons, legally -- even though you may be wondering whether it's the police who need to be subject to better gun control.

In Bethlehem, city officials are asking why criminal charges should be filed in the death of John Hirko Jr., killed in 1997 by a police officer's fully automatic MP5 assault weapon. They're upset over nearly $8 million the city must pay after a jury found the city violated Hirko's civil rights.

If such charges are filed, we'll have one more criminal case involving legally owned machine guns -- and in both cases they were fired by the police.
