So the qualification in the 14th ammendment doesn't not extend all US Citizens rights to anyone....just the right to due process and equal protection under that law. Which is how a civilized society should behave. Some rights are universal human rights.

So where's the issue then? The 14th wasn't created to protect ILLEGALS was it?

Those limitations and regulations were to be made by the state and federal legislative bodies. There were no (constitutional) limits to what the states could regulate until 2010.

Bad logic on your part. Are you claiming the 14th Amendment was not addressed to the issue of freed slaves?

That is not what you said in an earlier post: "I know why it was passed, it was passed because of Southerners propensity to refuse citizenship to certain classes of people and use that lack of citizenship to discriminate against them. The Amendment defined citizenship and then PROHIBITED taking certain rights from NON-CITIZENS (ANY PEOPLE) ever again."

Because that was the reason the 14th was passed does not mean that today its application is limited to that issue just like the 2nd is not limited to muskets.

Read it, it is clear.

States are prohibited from taking from ALL PERSONS "Life, liberty, or property, without due process of law or deny ANY PERSON within its jurisdiction of the EQUAL PROTECTION of the laws.


Are you going to argue that ALL PERSONS and ANY PERSON means only Citizens? If you buy that silly argument, why did the writers of this Amendment separate the two categories with a semicolon?

" Subject to the jurisdiction thereof" =/= "just happening to be there".




2. Its original meaning refers to the political allegiance of an individual and the jurisdiction that a foreign government has over that individual.

That term is defined in federal naturalization law as those, for example, who are children of foreign ambassadors or diplomatic personnel. So the kid of a ambassador born in the U. S. is not a citizen.

I find "subject to the jurisdiction" to be very enlightening. It means they must follow the US rule of law or face the penalty. ;) All it would take is one adjudicated law...…….to establish legal precedent. Then perhaps a visit to SCOTUS. FACE it....the only method to fix this "inhumane" broken system where the current rule of law is not being adhered.....is via executive emergency orders. If the democrats refuse to obey their oaths in protecting the sovereign borders of our nation, its the duty of the POTUS to act accordingly.

Then the 1st Amendment must only apply to letters written on parchment and delivered via horse or wagon or standing in the town square and voicing your opinion.
